Issue: John and Jenny checked in a room of five stars- Footscray Ritz Hotel for their honeymoon. There has been a notice at the reception that hotel will not be responsible for any kind of theft or misplacement of your possessions. The hotel has prominently declared itself aloof from any sort of responsibility of losses by stating the sign that hotel will not be responsible for any lost or stolen property. However, no contract has been made and no document has been signed in this regard. As Footscray is a five star hotel, it will help certain moral duties and goodwill to take care of the valuable of its guests.
Rule: It is the responsibility of the hotel management to take care of the valuables of their guests. The sign on the doorway however, made Jenny reliable for leaving her valuable ring in the bathroom. Here another issue arises that the theft has taken place inside the room rented by the couple, the hotel keeper usually check in the room to clean up the bathrooms, makeup the bed sheets and arrange the room. So the ring might have been stolen by the room keeper.
Application: Jenny should take care of her valuable possessions as the hotel clearly states that it won’t be responsible for any kind of loss, but as a matter of fact, the couple would not have noticed the sign board and they may not understood the language in which the declaration has been made. Moreover it may lead the contract to be voidable if the plaintiffs are unable to comprehend the message delivered by the hotel.Another issue that the room keeper responsible to clean the room in absence of the couple, may be the one who has stolen the ring, but until a document has been signed by the room keeper to held him or her responsible for any loss to the possessions, he or she cannot be considered liable.
