雇主采取的任何行动,即基于其参与工会而终止或歧视或骚扰雇员,将被视为非法行为,组织将陷入严重困境。如果工人自己选择了一个工会,而且有一群雇员支持了他们,那么他们可以一起使用集体谈判的权利与组织及其管理(Edmans,Li and Zhang,2014)。他们可以谈论他们的转移时机,环境,薪水,工作条件,终止原因,转移到其他部门,事先通知任何问题;其他好处等,并明确自己的要求。



Any action taken by the employer i.e. termination or discrimination or harassment against the employee on the basis of his involvement with the union, will be considered as illegal and the organization will be in deep trouble. If the workers have chosen a union for themselves and a group of employees have supported them, then they all together can use their right of collective bargaining with the organization and its management (Edmans, Li and Zhang, 2014). They can talk about their shift timings, environment, salaries, working conditions, causes of termination, shifting to other branches, notices in advance regarding any problem; other benefits etc. and make themselves clear about their demands.

Every coin has two sides. It means that if collective bargaining has advantages, it has its own disadvantages as well. Firstly the main disadvantage is strike by the workers. If the management does not agree upon the demands of the union, they go on strike which put the organization in bad situation and becomes harmful for the reputation of the organization and its senior management as well. Whenever the union goes on strike, everyone suffers including the workers and those people who are directly or indirectly associated with the organization. Secondly, there is no social security for the public interest of the employees. There could be problems within the union as well; the stronger union puts enough pressure on the weak workers who work at fix wages. In USA, industrial relations take control on collective bargaining, but it often disrupts the whole economic situation of the country, endanger the healthy environment and security of the people, and even becomes the reason of the price rise for the general public (Western and Rosenfeld, 2011). Thirdly, the union becomes powerful after their successful negotiation with the management which usually gives rise to the conflicts.
